TERMS OF SERVICE
For those who want to commission artwork, please read below! For any further questions please contact me at [email protected]
General
By asking and paying for my services you automatically state that you understand and agree to my terms and conditions.
I reserve the right to refuse your commission order without any reason or explanation.
I have the right to alter my terms of service at any time. New rules will not apply retroactively and won't influence orders started on older terms.
Ordering
Displayed prices are for reference only. Each price is tailored to fit an individual commission depending on wishes, complexity, and character design. If you wish to get a quote please contact me via email!
Displayed prices are for personal, non-commercial commissions only!
Quotes can be requested at any time, outside of the opening period as well. Quotes are viable for up to 2 months.
There is no waiting list option or reservation.
Commission description should contain clear visual reference [except character design type] and brief description.
References should be concise, up to date, and written in English. Any changes outside of the initial project and price agreement must be discussed and additionally approved. Changes may be individually charged depending on their complexity.
Commission order will be terminated if the client is unable to use English in understandable form.
If order involves multiple people, all communication with the artist should be handled by a single representative elected privately by said group. I will not be involved in any quarrels among the group members nor responsible for the resulting situations. All updates will be passed to selected representative and distributed among group members on their own. In situations where payment is made by a different person than the ordering client - all updates and communication will be handled with the representative (usually the person the quote was given to).
The opening of commissions usually attracts more people and commission ideas than I am capable of fulfilling during a single month. Please be prepared for the possibility of waiting for another opening to get your commission. I do my best to suit everyone, but I sadly can't accept everything at once.
By commissioning an artwork from me you understand that the piece will be drawn in my art style.
Payments and Refunds
Payments can be made via Bank Transfer, Wise or via PayPal.
Should you choose Bank Transfer, because of the nature of the transaction it may take a couple of days for the payment to come through. In this case I require a proving receipt from your bank of the transaction.
In the case of PayPal an extra +7% will be added to the final price to cover the PayPal fees (for reference see the "with tax" column of the prices!)
All invoices are due within 15 days from receiving them, unless agreed otherwise. Invoices past the due date will be canceled, also canceling the commission associated with it.
Payments without prior invoice won't be accepted.
Due to local tax laws for each and every commission I need to have the client’s real name and address to create the receipt. (In case of PayPal, please include the email connected to your PayPal so invoice can be prepared and sent.)
All payments should be fulfilled upfront with exception of payment plans.
Individual payment plans are available for artworks above $300. In case of multiple installments I prepare the sketch once the 50% threshold of total price is reached. Work is continued once the full price is paid.
Refunds can be requested at any time.
Full refunds are issued only before the start of work on order in question.
If commission is being canceled during the creation process refunds will be calculated depending on the state of the artwork.
Creation process, Revisions, Deadlines
Commission list doesn't reflect the queue/work order.
Deadline, if needed, has to be communicated and agreed upon before the initial quote. Deadlines affect the price and can be refused.
With exceptions of sketches each commission type will receive a sketch stage for approval and right to revision.
Further work-in-progress updates may or may not be shared depending on clients wishes.
Revisions depend on commission type. Revision right applies for any kind of art above $200 with one possible revision. Full Illustrations get up to two applicable revisions. [Revision - major alteration of initial sketch]
Final edits and adjustments are always welcome, but not included in the initial quote. They may be charged depending on complexity.
Any additional work outside of the initial project and quote will be charged accordingly.
Copyright and Licensing
As the artist I retain the copyright to the commissioned artwork. I retain the right to publish the piece on any of my social media profiles, in my portfolio, use it for self-promotion and stream the drawing process on Twitch.
You are ONLY allowed to use your commissioned artwork for personal or non-profit means.
You may use the commissioned artwork as you wish as long as the purpose is personal, and non-commercial, including but not limited to create physical copy of the artwork for personal use only, using it as mobile/PC background, profile/header image and sharing the artwork on social media with proper and visible credit to the artist.
You are not allowed and you have no right to use your commissioned piece and any of my artworks for anything involving NFTs and AI/ML. I do NOT consent.
If the commissioned artwork is meant as a gift, the client takes full responsibility and is required to inform the recipient about the terms of the use of the artwork under any circumstances.
I do not claim any rights to characters and other intellectual properties used in the process of creation.
Artworks created should be maintained as for personal use only, and shall not be reproduced, resold or used for profit in any ways without my direct permission.
Every client has the option to buy full rights to commissioned artwork. Details will be discussed individually.
A creator license may be purchased for an additional 50% of the final price and allows the commissioned piece to be used on streaming or other platforms which would allow you to earn money out of your content (eg.: Twitch, Youtube). You may use the commissioned art as part of your layout or promotional purposes on your social media sites with properly crediting me as the artist
Commercial licenses may be purchased for an additional 100-300% of the price. The final price - including other potential royalties and additional terms - will be discussed upfront based on the project itself and how the commissioned piece is to be used.
